Untitled have done their utmost to ensure that all works displayed on the website are available for sale. In some cases a works may be marked as "sold" if the Artist has no other available works to replace sold pieces. Enquiries can be made in order to find out whether or not works are or can be framed. If a paintings is marked as "unavailable" this may be for reasons such as it is being exhibited or has been loaned. This does not necessarily mean that it is not available for your purchase. Please feel free to contact us with any availability queries.
As stated, Untitled are willing to consider offers made and will consult the Artist in question in order to confirm or decline the offer. On Untitled accepting your offer you may then follow the basic payment steps as instructed in our "how to buy" section, otherwise please "contact us" for further assistance. On any such purchase Artworks will only be despatched after receipt of full payment. Untitled reserves the right to decline any offer under the full displayed asking price.
Our online buying facility allows you to make quick, easy and secure payments on any number of different items. We accept all main Credit and Debit Cards. If you wish to pay by Cheque then please contact us for the relevant address making cheques payable to: Untitled.
All of the Artworks purchased will be packed appropriately and dispatched as quickly as possible. At Untitled's discretion Clients should expect to wait no more than 6 - 8 working days (in most cases it should be quicker, although Untitled are excused from the performance of its obligations if performance is hindered or prevented directly or indirectly by strike, lock out, labour disturbance, government action, riot, armed conflict, accident, unavailability or breakdown of normal means of transport, Act of God or any other matter beyond its control).
All postage and packing costs are included in the price set and then you will not have to pay any further amount towards this service (unless in extreme circumstances, i.e. very large or heavy pieces or delivery outside of the U.K.). If for example the Artwork arrives in an unsatisfactory condition (although Untitled will do their utmost to pack, handle and despatch the Artwork to the very best of their ability in very rare cases some problems may occur in transit) then the Client will become responsible for the costs of returning it safely and insured (in the condition it was received) to Untitled's designated address. The Clients statuary rights will not be affected by this. On requesting the return of payment the customer will remain responsible for all shipping costs for the initial delivery and return of the item as well as WorldPay fees charged for the transaction for secure online payment received (up to 6% of the total selling price) as well as insurance and packing costs in both directions. These costs will be deducted from the refund to the customer.
The consumer has the right to cancel any purchase within seven days of their contract with Untitled, or seven days of receipt of the goods (whichever is the longer). If the customer cancels their order they will have their payment returned by the most appropriate and efficient means possible. The right to cancel is fundamental; however this is balanced in the Regulations by the Consumer's Responsibility to take care of the goods before and when returning them. Untitled will return the outstanding payments only on safe return of the Artwork. All works must be returned in the condition they were received.
If the Client wishes to view an original piece, then where possible, it can be arranged for the Client to visit the Artists Studio or Untitled office to do so. Please contact us if it is more convenient to collect the work to personally ensure its safety. For Client and information security Untitled is protected from spyware and viruses by three different protective measures. This allows Untitled to send and receive information securely via e-mail. All provided information will be stored securely and will under no circumstances be
disclosed to any third party without the full consent of the Client.
The transfer of the purchase details from the retailer's site to Worldpay are encapsulated using our own encrypted and digitally-signed protocol. This uses a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof via SSL.
Any communication between the shopper and WorldPay is also encrypted to the maximum strength supported by the shopper's browser using 128 Bit SSL. Shoppers are also protected from fraudulent use of their card in a "card not present" environment, by their card issuers. The card issuers provide the right for shopper to dispute a transaction if the goods/services did not arrive or if the card was used fraudulently.
Data storage on WorldPay systems, and the communication between WorldPay and the worldwide banking networks, is regularly audited by the banking authorities to ensure a secure transaction environment. We also ensure that we stay up-to-date with the latest versions of any third-party code we use, and continually review our own proprietary code.
When signing up to Untitled the Client automatically gives full consent for Untitled to use their personal data such as e-mail and postal address to contact them freely and when required post relevant invitations or newsletters without lawful breech of the Data Protection Act 1998. (Information given will be used to allow the Client access to otherwise restricted areas). Client details will only be used (in compliance with the Data Protection Act) in order to assist sales between Untitled and the Client. Purchasing Clients must be over the age of 18 at the time of purchase unless Untitled receive full consent in writing from the parent or guardian of the Client.
